B.C. aims to recoup health care costs for snowboarder who was injured in slide off a cliff

The B.C. government is suing Blackcomb Skiing Enterprises to recover the health care costs of a snowboarder injured two years ago after going over a cliff.

Amanda Yan was snowboarding on the mountain on April 19, 2008, when her snowboard caught an edge, causing her to fall. Yan slid off the Crystal Road run, down a steep embankment and over a cliff, the legal action claims.

She suffered a mild traumatic brain injury, dislocated two vertebrae and fractured three other vertebrae, according to the lawsuit filed in B.C. Supreme Court. She also fractured her right thigh bone, a wrist bone in her right hand and suffered injuries to a lung and left kidney, the plaintiff claims.

The province, which is seeking past and future costs of health care, claims the ski hill was negligent in failing to erect a barrier that would have prevented Yan from going down the snow bank and over the cliff, and failed to erect a sign warning users of a sharp drop-off and cliff. The legal action also claims the operator of the Whistler Blackcomb ski resort failed to take adequate measures through maintenance and inspection to ensure the ski run was in reasonably safe condition.

Poor girl, not only for her injury but being put in between the cross fire. I got a feeling that if the government won it will set off a chain reaction and insurance premium for resorts will sky rocket. Ontario has always been sensitive to that kind of legal matter. $200 for 5x7 may be approaching.

At least, the government pays to the girl (by health care), and sues the resort.

What if you get hurted, you go to the health care, they say "go to ask the resort". You go to the resort, they say "go to ask the health care"...... You don't get medical attention, and you can't afford to sue anyone.

Yeah, the health care system that Canadians are 'once' proud of. And we are seeing day by day that its falling apart. Does whistler deserve to get sued? .. the facts of what'd happened is not for us to judge. But obviously BC government is desperate to get their money back. Our health system is way overloaded I'm wonder what else will it cover by the time we get old.
